In family finance cases it is easy to assume that the bigger the asset pool the easier the case. JK v LM [2026] EWFC 32 (B) proves that this is not always true. On paper the parties had assets totalling just over £2.3 million. The case was framed as a “needs” case, meaning the focus should have been on ensuring that both parties and their children had enough to live comfortably. The court found that there were more than sufficient funds for housing and maintaining a reasonable standard of living.
Yet despite this the parties had spent over£200,000 on legal costs before reaching a resolution. The judge was clear that this case should not have been difficult to resolve. What made it complex was not the assets themselves but the way the litigation was conducted. Minor disputes, historical accounting exercises and arguments over past contributions dominated the proceedings, distracting from what really mattered, fair division and meeting the family’s needs.
The judge emphasised that financial remedy proceedings are not an invitation to turn the case into a forensic audit. Expert evidence should be used where it is necessary, disclosure must be full and honest and irrelevant points should be set aside. The court criticised the excessive legal wrangling and highlighted that disproportionate litigation wastes time, money and court resources.
This case also underlines the importance of early case management. Identifying the real issues at the first appointment, narrowing disputes and deciding what evidence is necessary can prevent unnecessary escalation. The Family Court’s powers are wide and when used effectively they keep proceedings proportionate and efficient.
